Public thanks to the LewMan for lunch today. It wasn't quite Kokomo -- admit it, Lew, the ambiance just WASN'T there -- but it was delightful company.

Oh, and Tom, thanks for the dance.

While we were eating, Lew talked about his Clarence Darrow career, and the subject of "National Drivers Licences" came up.

'Twas quite interesting to me, because I've never looked at it from Lew's perspective. His take is that a NDL would significantly decrease the number of DUIs.

However, he also said that repeat offenders generally lose their licenses after the third offense.

Would we be safer if a NDL got yanked? Is that any different from Mr. LewMan's Client getting busted in Indiana and then getting a Kentucky license?

I think not. (There you go Raven. I gave my opinion. Your turn now.)

Well, while a NDL would cut out the possibility of going to another state to get a driver's license it wouldn't stop someone from driving, even if they don't have thier license. Quite frankly, if they are stupid enough to drive drunk, not only once but three times, then they are most likely going to drive if they have a license or not.

I don't get it, if your license is yanked you can just go to another state and get a license even if you don't live there? Or are you saying folks will move out of state in order to get a license?

    Well, and to follow-up...

Gae asked me why is it you hear about John Doe who has a dozen DUIs? And my response to her was that, on the whole, it's hard to accumulate that many in one state because, after awhile, jail time starts to accrue big time.

However, I have had clients who had over 10 DUIs, but they had them in different states and with different licenses.

Jigsaw is correct that people are going to drink and drive no matter what.

But the variances in licenses does create problems. For example, say you have a Kentucky license and you get a DUI in Indiana. Indiana can say you can't drive in Indiana for X-number of days. But KY doesn't recognize Indiana punishment, so you can still drive in KY.

And for the record, Gae, as always, looked hot today....

FYI....They have what is called a Commercial Driver's License for truck drivers. It based on the same theory, only one license so you can't rack up points on 3 or 4 licneses from diferent states.

Overall, it may have curved the problem....but then again, if you know the right people, you can buy one at any truckstop.

In line with the "dig up Jefferson" idea, WWJD? (What would Jefferson do?)

    Let's see, Kentucky Resolutions 1798.....
That the several States composing the United States of America, are not united on the principle of unlimited submission to their general government.....reserving, each State to itself, the residuary mass of right to their own self-government; and that whensoever the general government assumes undelegated powers, its acts are unauthoritative, void, and of no force.
    <font size="2" face="Verdana, Helvetica, sans-serif">No National Driver's License.

I would counter-propose a pact between states, freely agreed upon, wherein information relating to driving offenses are shared and accumulate to all states agreeing to the pact.
